Owning families, family businesses and companies in financial difficulty

Family Business and Restructuring

We help family businesses organise the transfer of ownership and management, and support distressed companies in restructuring their obligations.

Family businesses face questions where family relationships meet company management, such as passing management between generations and organising the rights of heirs and partners. We also advise companies in financial difficulty, from assessing their current position to reviewing the procedures available under the Bankruptcy Law, to protect rights and support business continuity.

FAQ

Before you get in touch

When does a family business need a family charter?

A charter helps when several family members share ownership or management, or when management is about to pass to a new generation. It is best prepared before a dispute arises, not after.

Is a family charter legally binding?

Its effect depends on how it is drafted and linked to the company's documents and signed agreements. We explain which provisions should be reflected in the articles of association or partners' agreement to be enforceable.

Does bankruptcy always mean liquidation?

No. The Bankruptcy Law includes procedures aimed at financial reorganisation and settlement with creditors, alongside liquidation. We explain the appropriate procedure for the company's situation.

How do you handle private family matters?

We treat family and financial information confidentially and limit access to what the agreed work requires.
